Introduction
Welcome to Yana ("we," "our," or "us"). By accessing or using our services, including our mobile application and website (collectively, the "Services"), you ("User" or "you") agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read them carefully before using our Services.
Contractual Relationship
These Terms constitute a legally binding agreement between you and Yana. If you do not agree to these Terms, you may not access or use our Services. We may terminate these Terms or any Services with respect to you, or generally cease offering or deny access to the Services or any portion there of, at any time for any reason.
The Services
Yana provides a platform that connects users with third-party transportation providers ("Drivers") to facilitate ride-booking services. We do not provide transportation services ourselves and are not responsible for the actions or omissions of Drivers. The Services are made available solely for your personal, non-commercial use.
User Accounts
To use most aspects of the Services, you must register for and maintain an active personal user account ("Account"). You must be at least 18 years of age to obtain an Account. Account registration requires you to submit certain personal information, such as your name, address, mobile phone number, and age, as well as at least one valid payment method. You agree to maintain accurate, complete, and up-to-date information in your Account. Failure to do so may result in your inability to access or use the Services.
User Conduct
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
- Remove any copyright, trademark, or other proprietary notices from any portion of the Services.
- Reproduce, modify, distribute, license, sell, or resell the Services without our express permission.
- Decompile, reverse engineer, or disassemble the Services, except as permitted by applicable law.
- Link to, mirror, or frame any portion of the Services.
- Cause or launch any programs or scripts for the purpose of scraping, indexing, or data mining any portion of the Services.
- Attempt to gain unauthorized access to or impair any aspect of the Services or its related systems or networks.
Payment
You understand that use of the Services may result in charges to you for the services you receive from a Driver ("Charges"). After you have received services obtained through your use of the Service, we will facilitate your payment of the applicable Charges on behalf of the Driver. Charges will be inclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by Yana.
Disclaimers; Limitation of Liability; Indemnity
The Services are provided "as is" and "as available." We disclaim all representations and warranties, express, implied, or statutory, not expressly set out in these Terms. We do not guarantee the quality, suitability, safety, or ability of Drivers. You agree that the entire risk arising out of your use of the Services remains solely with you.
In no event shall we be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the Services, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold us and our officers, directors, employees, and agents harmless from any claims, demands, losses, liabilities, and expenses arising out of or in connection with your use of the Services or violation of these Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of Uttar Pradesh, India, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal or state courts located in Lucknow.
Changes to Terms
We may amend these Terms from time to time. Amendments will be effective upon our posting of such updated Terms on our website or through the Services. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms, as amended.
